TERMS AND CONDITIONS

This page (together with the documents referred to on it) tells you the terms and conditions on which we supply any of the products listed on our website www.doordeals.co.uk to you. Please read these terms and conditions carefully before ordering any products from the site. You should understand that by ordering any of our products, you agree to be bound by these terms and conditions.

You should print a copy of these terms and conditions for future reference.

Please click on the button marked “I Accept” at the end of these terms and conditions if you accept them. Please understand that if you refuse to accept these terms and conditions, you will not be able to order any products from our site.

Terms and Conditions

1. General

1.1 These conditions shall apply to all trading between Doordeals LTD and the customer.

Acceptance by Doordeals LTD of an order is conditional upon acceptance by the customer of the following conditions.

1.2 No variation of these conditions shall be binding upon Doordeals LTD unless previously agreed by Doordeals LTD in writing.

1.3 All doors are sold “subject to availability”. Doordeals LTD can not be held responsible for the manufacturer’s decision to withdraw any doors from production or change their manufacturing techniques.

1.4 www.doordeals.co.uk is a site operated by Doordeals Limited (Doordeals LTD). We are registered in England and Wales under company number 06288058 and with our registered office at Unit 3, Sheaf Gardens, Duchess Road, Sheffield, S2 4BB. Our VAT number is 916 2035 50.

2. How the Contract is formed between you and us

2.1 After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the product has been dispatched (the Dispatch Confirmation). The contract between us (Contract) will only be formed when we send you the Dispatch Confirmation.

2.2 The Contract will relate only to those products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other products which may have been part of your order until the dispatch of such products has been confirmed in a separate Dispatch Confirmation.


3. Consumer Rights

3.1 If you are contracting as a consumer, you may cancel a Contract at any time within 7 days, beginning on the day after you received the products. In this case, you will receive a full refund of the price paid for the products. Please note that the provisions of this clause 3 only apply to consumers.

3.2 To cancel a Contract, you must inform us in writing. You must also return the product(s) to us immediately, in the same condition in which you received them, and at your own cost and risk. You have a legal obligation to take reasonable care of the products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.

4. Placing an Order

4.1 All products must be paid for in full before delivery or upon collection.

4.2 Credit card & Cheque payments are subject to usual bank clearing periods.

4.3 All goods will remain the property of Doordeals LTD until full payment is made and all funds have cleared.

4.4 By placing an order through our site, you are warranting that you are legally capable of entering into binding contracts and you are at least 18 years of age.

5. Prices

5.1 Doordeals LTD has the right to alter prices without prior notice.

5.2 Orders are accepted at the prices applying at the time of order.

5.3 All prices quoted are inclusive of VAT but exclude delivery costs, which will be added to the total amount as set out in our Delivery Information guide [http://www.doordeals.co.uk/delivery.asp] (which form part of these terms and conditions).

6. Delivery of goods

6.1 Your order will be fulfilled within a reasonable time of the date of the Dispatch Confirmation,

unless there are exceptional circumstances.

6.2 Doordeals LTD will not be liable for any claims arising due to delay as a result of strikes,

materials, shortages or any circumstances beyond our control.

6.3 No goods will be released (upon delivery) without a signature from the customer or his/her representative unless you give your specific consent to us to release the goods without obtaining a signature first. In the event that you give such consent you agree to be bound by these Terms and Conditions as though a signature had been obtained.

6.4 The goods will be at your risk from the time of delivery.

7. Products

7.1 Doordeals LTD reserves the right to withdraw products from sale without prior notice.

7.2 All products (except ex-stock) are guaranteed for 12 months from the date of purchase against faulty materials or manufacture, provided that Doordeals LTD shall be under no liability under the said guarantee if (a) the customer has not paid in full for the goods; or (b) the customer is claiming for damage which the customer should reasonably have been expected to have noticed upon initial inspection, prior to signing a proof of delivery acknowledging that the goods are in a good condition (in accordance with clause 6.3); or (c) the customer has executed or attempted to execute repairs or alterations (includind applying or attempting to apply a paint or stain covering) to the goods which are not authorized by Doordeals LTD or has failed in any other respect to store the goods correctly or has mishandled the goods or failed to adhere strictly to the terms of hereof; or (d) Doordeals LTD has not been notified of any defect within one week of the defect becoming apparent. Ex-Stock doors are “sold as seen” and do not carry a guarantee and are non-returnable.

7.3 As timber is a natural material it is subject to changes in temperature and humidity. Doordeals LTD does not accept liability for natural movement or distortion, warping, swelling, or splitting caused by the product being exposed to extremes of temperature or humidity, or if it is not correctly stored, treated or hung (see care and treatment of your product below).

7.4 Some of the timber products pictured in our web site and other literature have been pre-finished (stained, waxed or lacquered) prior to photography and therefore may not be an exact representation of the product you may have selected. Vagaries of the printing process mean that colours shown may vary slightly from the final product.

7.5 All timber products are supplied unglazed and unfinished unless otherwise specified. Timber products ordered at different times may come from a different batch. All reasonable efforts will be made by Doordeals LTD to match, however no responsibility will be accepted where variations occur.

7.6 Most doors must now meet building regulations document ‘L’. It is your (the customer’s) responsibility to make sure that you order correctly to meet these regulations and we will not be held responsible if you do not. If you are in any doubt as to what to use, contact your local building inspector.

7.7 Where glazed doors are supplied. Please note that to ensure the best possible care during transit, the glass may either be temporarily fixed to the door, or sent through separately.

8. Goods ordered in error

8.1 Subject to the provisions of clause 3, Doordeals LTD may at its discretion exchange

goods to the same value subject to the return of the goods ordered in error, in their original condition. However a surcharge of 20% will be deducted for handling and restocking.

9. Defective & Faulty Goods

9.1 Notwithstanding the provisions of clause 7.2, if you believe that your products are defective in any way, you must advise

Doordeals LTD within 7 days from receipt of the goods. All packaging and goods must be retained by the customer for inspection. In the event of goods proving to be defective (Manufacturer’s defect only) which require replacement, the liability of Doordeals LTD shall not exceed the replacement value of the faulty goods.

9.2 Doordeals LTD shall not be responsible for any incidental work or expenses arising out of or because of any defect in our product, or bad workmanship applied to our products. Notwithstanding the provisions of clause 7.2, products found to be faulty within 1 year of purchase as a result of workmanship or materials will be repaired or replaced (at our discretion) free of charge after proof of purchase has been established. No responsibility however can be accepted if wrongful or incomplete installation was carried out by the customer or its representative.

10. Our liability

10.1 We warrant to you that any product purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied.

10.2 Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the product you purchased.

10.3 This does not include or limit in any way our liability:

a) For death or personal injury caused by our negligence;

b) Under Section 2(3) of the Consumer Protection Act 1987;

c) For fraud or fraudulent misrepresentation; or

d) For any matter for which it would be illegal for us to exclude, or attempt to exclude our liability.

10.4 We are not responsible for indirect losses which happen as a side effect of the main loss or damage, including but not limited to:

a) loss or income or revenue;

b) loss of business ;

c) loss of profits or contracts;

d) loss of anticipated savings;

e) loss of data; or

f) waste of management or office time.

however arising and whether caused by tort (including negligence), breach of contract or otherwise.

11. Cancellations and Delayed Deliveries

11.1 Subject to the provisions of clause 3, cancellation of orders will only be accepted when all

costs and expenses, or loss or damage incurred by Doordeals LTD by reason of the cancellation, have been met by the customer.

11.2 All cancellations must be received in writing. Subject to the provisions of clause 3, a handling charge of 20% will be made for costs incurred by Doordeals LTD due to suspension or deferment of orders.

12. Written communications

12.1 Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communication that we provide to you electronically comply with any legal requirement that such communication be in writing. This condition does not affect your statutory rights.

13. Notices

13.1 All notices give by you to us must be given to Door Deals Limited at Unit 3, Sheaf Gardens, Duchess Road, Sheffield, S2 4BB. We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified in clause 12 above. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or 3 days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

14 Waiver

14.1 If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.

14.2 A waiver by us of any default shall not constitute a waiver of any subsequent default.

14.3 No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with clause 12 above.

15. Severability

15.1 If any of these terms and conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be served from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.


16 Entire agreement

16.1 These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

16.2 We each acknowledge that, in entering into a Contract, neither of us has relied on any representation, undertaking or promise given by the other or implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these terms and conditions.

16.3 Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently) and the other party’s remedy shall be for breach of contract as provided in these terms and conditions.

17. English Law

17.1 Any contract made subject to these conditions shall be deemed to have been made in

England and shall be governed by English Law and the parties shall be subject to the exclusive jurisdiction of the English Courts.

18. Statutory Rights

18.1 These Terms and Conditions do not affect your statutory rights.

Care and Treatment of Your Products

19. Timber Products

19.1 The care taken during manufacture and the quality of the raw materials ensure that your

timber products will give you many years of good service, providing they are treated and stored in accordance with our recommendations (see below).

19.2 Timber is a natural material, which is subject to changes in temperature and humidity, it is common for natural movement or distortion, warping, swelling or splitting to occur if the door is exposed to extremes of temperature or humidity, or it is not correctly stored, treated or hung. A bow of up to 4mm along the length of the door is considered to be within the manufactured tolerances.

Our Recommendations

19.3 STORING

  • Prior to fitting, doors should be stored flat (never on edge or on end) on a level surface and be kept clear of the floor on at least three level bearers. The bearers should be longer than the doors.
  • Ideally store in a cool dry atmosphere. Do not store (or hang) in a newly plastered room or suddenly expose to central heating or other forms of direct heat.
  • Doors should not be STORED or FITTED in a building until the wet trades are finished and fully dried out. This is very important as any moisture penetration from wet plaster, cement render, etc can result in the door swelling and can even cause the breakdown of the joints.

19.4 FITTING

  • On the width where a size reduction is necessary, always take equal amounts from each side up to a maximum of 8mm. When reducing the height you can usually take a fraction more from the bottom but please check with supplier for maximum amounts.
  • Avoid fitting any Mortice locks/latches along the rail joints as this can severely weaken the integrity of your door.
  • A suitable weatherboard (two on stable doors) must be fitted on all external doors and a head drip (fitted to the frame) on an outward opening door.

19.5 FINISHING- EXTERNAL DOORS

  • PAINTING It is vital that that your door be treated with a least one primer coat ,two undercoats and a top coat prior to installation (including cut outs for letterboxes, hinges, locks etc…) Once fitted it is essential that both faces, all cut outs (AND MOST IMPORTANTLY) all four edges (as the top and bottom of doors contain end grain which are more susceptible to moisture penetration) are sealed with at least 2 further coats (preferably 3) of finishing treatment once the door ha been hung. Always apply the correct number of coats as at the right time intervals as recommended by the manufactures. Always sand the door lightly between applying coats, and remember that it is NEVER sufficient to treat just one side of a door. Failure to follow these instructions may invalidate your Guarantee.
  • STAIN/VARNISH We advise the use of a “MICRO-POROUS” wood stain or varnish, something with a “hard finish”. We recommend at least one base coat followed by four top coats (two of which must be applied prior to fitting). Manufactures to look out for are Sadolin, Hicksons, or Sickens. Please follow the same instructions as when painting (see above) Pay particular attention to applying a finish to all 4 edges and any cut outs. Failure to follow these instructions may invalidate your Guarantee
  • OILS, WAXES AND WATER BASED TREATMENTS INCLUDING PAINTS FOR EXTERNAL DOORS. We do not advise the use of any oil, wax or water based (quick drying) treatment on your external door. We feel they do not offer enough protection against the elements and therefore we will not offer any guarantee if they have been finished in this way. If you are in doubt please contact us for further advice.

19.6 FINISHING-INTERNAL DOORS

  • For painting we advise you follow the same instructions as given to finishing the external doors. Like external doors, it is important one coat of finishing treatment be applied prior to installation. With the finishing top coats applied immediately upon fitting. Again, pay particular attention to any lock/latch cut out and all four edges.
  • All types of internal doors can be treated with an oil based stain or varnish. Certain doors such as ash, oak or walnut (veneers) may be treated with” Danish oil” or similar. Be sure to follow the manufactures recommendations. If you are in any doubt please contact us for further advice. Like external doors, we do not advocate the use of ANY water based finish, as (with veneered doors) it can cause bubbling and the veneers to lift. We also feel they do not offer sufficient protection and therefore will invalidate your guarantee.

Website Usage

In addition, you are not to modify, distribute or re-post anything from our site for any purpose at all.

3. Our site is provided "as is" and we don't give any guarantees or promises in respect of the site or its performance. In particular, we give no guarantee as to the quality of our site, its suitability for any particular purpose or the level of skill and care used in making it available to you. Any terms of this nature which may be implied automatically by law are excluded (to the extent legally permitted). Providing the site "as is" defines that: - Although we try to make sure that everything on our site is accurate, we take no responsibility if it isn't; you use our site at your own risk. 8. In the event of any dispute, these terms and conditions will be governed by English law and heard before the English Courts. We do not wish to seem unfriendly, but if you do not want to be legally bound by these terms and conditions, please leave our site. How long will my door take to be delivered?

Here at www.doordeals.co.uk we try to deliver your doors as quickly as possible. We do not have an “exact” delivery lead time due to different doors taking different lengths of time to arrive. Below we have written a few different scenarios to give you an idea as to how long delivery would take. If you have any time constraints at all, please don’t hesitate to get in touch.

How long to deliver solid doors or doors without glass?

For these kinds of doors we can usually turn round within 10 working days. As we are growing as a company we are holding more and more doors in stock, so if it’s a stock item you choose, we can arrange delivery within the week or even offer a next working day service…

I want some glass with my door, how long does delivery take?

If the door you choose has only ONE glazing option it probably means that we buy it in pre glazed. This keeps the delivery times down to within 10 working days. Again if they are stock items this timescale can be reduced to a week. Unfortunately due to insurance requirements we are unable to send glazed doors next day, unless there is a larger quantity (over 7 doors) we would then be able to palletise and send next day.

I require double glazed units…

For external doors (or indeed external French doors) where double glazed units are required, this can add extra time to the delivery process. We first have to get the doors. Once the doors are here only then can we order the Double glazed Units. These can take up to a week to arrive. We then have to package and send the doors onto our courier. We usually estimate that for doors with double glazing requirements we aim to deliver within three weeks of your order.

I need my door for a certain date…..

If you are working to a deadline we will bust a gut to get the goods there for you. Give us a ring or send an email with what you want, where to and when you want it for, and we are honest enough to let you know if we can get it there for you. All the above timeframes are approximate. You may get the doors a little before. One thing is for sure we ALWAYS aim to work around the customer, so please don’t hesitate to get in touch with any questions you may have….

We aim to package all items as best we can, to try to prevent damage to the items in transit. All items are thoroughly checked for damage before dispatch. However, we cannot account for problems during transit so please be sure to use the following procedure upon receiving your delivery, while the driver is STILL PRESENT and BEFORE signing for it:

  1. Check the number of items correspond with to what is on the courier’s delivery sheet.
  2. Check the package over and if any part appears damaged or torn the consignment MUST BE signed for as damaged on the courier’s delivery sheet.
  3. Inspect the item as best you can while packaged, ideally unpack and check the item thoroughly.

If the package is damaged it MUST be documented on the courier’s delivery notes. This is a condition of the courier’s insurance that covers your item. Failure to do this will result in no cover for your item and replacements will be at your cost.

If the packaging is damaged but the goods are fine, then you need not take any further action. If the goods are damaged please follow the below instructions.

Damages

If the worst happens and your item is delivered damaged, please call us ASAP on 01142 557 800 to inform us. We will then organize for a courier to collect the item (if it has not been already returned). Once the item has returned to us we and we have checked it off, we will dispatch new goods to you AS SOON AS WE CAN.

NOTE: Replacements can only be sent free of charge if you have declared the item damaged on the couriers note. We reserve the right to refuse or charge for replacements if these steps have not been reasonably followed. We cannot be held liable for fitting costs incurred by goods arriving late or damaged. It is better to wait until you have the goods before you organize the fitting.

Returns

Subject to the provisions of clause 3 of the terms and conditions:

  1. We need to be notified of any returns within 7 days of receipt.
  2. Goods must be returned in the condition they are received in. e.g. in original packaging, not altered.
  3. Any returns are the buyer’s responsibility to return to us. We can arrange collection at your cost.
  4. Goods returned due to incorrect ordering or over ordering are subject to a 20% handling charge.
  5. Postage costs cannot be refunded on any goods ordered in error.
  6. Any refund will be given once the goods have been inspected after arriving back to us.
  7. If the goods are faulty we will replace or refund in full.
  8. We will not be held liable for fitting costs incurred by goods arriving late or damaged.
  9. Any made to measure goods purchased may only be returned if faulty. If they are wrong due to your measurements being incorrect, and it has been made to the agreed sizes, we will not refund or exchange.
  10. Any Slight second or part damaged goods cannot be returned.
  11. For goods that are damaged we will either exchange them or provide a full refund. This does not affect your statutory rights as a consumer.
  12. We reserve the right to refuse returns or refunds should the items not be returned to us in a saleable condition.
